Update: my buddy the lawyer said verbal lease is fine, now I'm out $4,800 in Dallas
My buddy who passed the bar last year told me a handshake lease with my storage unit landlord was legally binding in Texas, so I skipped the paperwork to save time. The landlord sold the property to a new guy who kicked me out with 5 days notice and kept my deposit plus 2 months of prepaid rent. Is there any way to recover that cash without hiring a lawyer for a case where I have zero written proof, or should I just eat the loss?
Honestly this reminds me of when my cousin let a guy "hold" his truck with just a text message and a handshake, and when the guy wrecked it he found out a text from 2021 was worth about nothing in small claims. He ended up getting half back only because the guy felt bad, not because of any paper. Tbh even a dumb scribbled note with both names on a napkin would've saved him. In your case a handshake deal is technically a thing in Texas but proving the terms is the whole ballgame, so the prepaid rent is gonna be way harder to claw back than the deposit.
